Texas Penal Code §49.04 states that a person who operates a motor vehicle in a public place while intoxicated constitutes the crime of Driving While Intoxicated.

Texas Penal Code §49.07 states that a person who operates a motor vehicle in a public place while intoxicated and causes serious bodily injury to another because of that intoxication has committed the crime of Intoxication Assault.
